Chapter 7
If your debt is mostly credit card debt, medical bills, or other unsecured debt, then your best option (should you qualify) is chapter 7 bankruptcy protection. A chapter 7 will discharge (completely wipeout) your unsecured debt. There are no monthly payments to be made in a chapter 7 bankruptcy except for your secured debts. The most common types of secured debt that you will have to pay is your house payment and car payment. If you are behind on your house or car payment, then you may want to consider a chapter 13.
Chapter 13
Consolidate your debt to an affordable payment. If you find yourself behind on your mortgage, car payment, property taxes or other secured debt, then a chapter 13 may be right for you. A chapter 13 will consolidate all of your debt to an affordable payment and stop all collection procedures. A chapter 13 will also allow you to save your property from repossession or foreclosure.
